Loren Schwartz Secures $1 Million Settlement for Workplace Accident Victim
Rouda Feder Tietjen & McGuinn is pleased to report that Partner Loren Schwartz recently secured a $1 million recovery for a client who was seriously injured in a workplace accident.
As court records show, Loren represented a client who had been at work assisting another company in the disassembly of a prefabricated modular office and the relocation of a large safe from one office to another. While working to move the safe, an employee from the other company, using a pallet jack, attempted to “catwalk” the safe away from the back wall. At this point, the safe fell off the pallet jack and onto our client’s left leg.
As a result of being crushed by the heavy safe, the tibial plateau – the flat area in the knee joint located at the top of the shin bone where the femur rests – in our client’s leg was shattered. The injury resulted in significant and debilitating pain for our client, who was a busy father of three, as well as expensive medical procedures and financial losses caused by an inability to work.
When investigating the incident, Loren and our team were able to identify critical issues in miscommunication and a series of unsafe work practices within the defendant’s on-site operations. Leveraging these findings, Loren was able to secure a settlement totaling $1 million.

This result speaks volumes about the experience, investigatory efforts, and unwavering commitment of our legal team.
It also serves as an important reminder that victims injured in the course of their employment may have options for pursuing civil personal injury claims outside of the workers’ compensation system, even though workers’ comp is traditionally the exclusive remedy for workers injured on the job in California.
This can be the case when injuries result from the negligence of third parties, property owners, or product manufacturers, or in instances of intentional harm caused by employers. When work injury victims pursue civil cases, they can recover broader compensation and damages that are not available through workers’ comp, such as pain and suffering.
